Catalog Description
Civil law is a branch of law which treats of private relations. The course will consider: Law of Persons, general principles regarding real and legal personality, beginning and end of personality, registry of personal status, capacity-persons as subjects of rights in general, capacity to act, personality and inherent rights thereof.
   
HKUK102Civil Law - II 
Catalog Description
The course begins with general information on the concept of the family in Turkish Law, then the notions of engagement, marriage, divorce and judicial separation are studied, together with their consequences. The course ends with a treatment of parent-child relations in relation to the concepts of legitimization, adoption, guardianship, curatorship and statutory advisors.

 

HKUK103Roman Law - I
Catalog Description
Roman law, which constitutes the basis of many legal systems currently in force in different countries, will be considered in two stages. In the first part of the course, following preliminary remarks on the history and political and legal development of Roman society, the sources and main principles of Roman law are examined. The course then considers the law of persons: the concept of personality, capacity in general -persons as subject to rights and obligations, the capacity to act and the concept and different types of legal persons, -e.g. agency, and finally, procedural and bankruptcy law and the judicial system of Rome.

In the second part of the course, within the law of property and the law of obligations the following topics are explored: The concept of real rights, ownership and possession, the concept of obligation, the contracts system in Roman law, different types of contracts, the question of liability objective and subjective liability and the termination of obligations.

Catalog Description
This course examines: Historical background of Turkish constitutional developments; the general characteristics of the 1982 Constitution including national state, democratic state, secularism, social state, the rule of law; the legislature, the structure of legislature, the legislative process, control over the executive, budgetary powers; the Executive, the President of the Republic, the Council of Ministers; the Judiciary, the independence of the judiciary, the Constitutional Court and judicial review of the constitutionally of laws.

Catalog Description
The main purpose of this course is to provide students with basic concepts of law and legal order. In this context: Religious rules, rules of manners, moral rules, and legal rules are compared and definitions of law and legal rules are derived. The sources of law are then treated: customary rules, written rules-hierarchy of norms-laws, decrees, regulations, and judicial decisions and doctrine.

HKUK241Judicial Review in Turkish Republic of Northern Cyprus 
Catalog Description
In this course judicial review will be clarify in order to historical development. A constitutional judgment is a process applied by the judicial organ in order to the control the appropriateness of laws to the highest norms of constitution. There are two types of constitutional judgment depending on two meanings: narrow and wide meaning, and material and physical meanings. These theories are also accepted in TRNC Constitutional System. In the Turkish Republic of Northern Cyprus (TRNC), constitutional judgment has been formed for the first time by the constitution of the Republic of Cyprus. In the Turkish Republic of Northern Cyprus, the Constitutional Court, formed within the Higher Court, exercises constitutional inspection. In Cyprus, pre-inspection and removing inspection constitutional systems are applied. The constitutional judgment methods will be clarify The norms subject to inspection in TRNC are; laws, law amending ordinances, regulations, statutes, by laws, council internal regulations, and council decisions. There exist no absolute judgments on whether the constitutional changes are liable to the constitutional judgment or not. Further duties of the Constitutional Court will be explain in this course system suc as resoling authority conflict between various organs, judgment as high council of state (divan), financial inspection and close of political parties and interpretation. Also, in this course, general principle of law, constitutional principle and law and the fundamental standard of norm of the TRNC Constitutional Court will be examined. For the TRNC Constitutional Court, norms will be study as the norms. The constitutional judgment course, in TRNC ends at the constitutional court, with the foundation of the constitutional court, judgment procedures, sanctions enforced at the court and features of the decisions of Constitutional Court.

Gender and Law aims to analyze the relation between gender and legal order. This course first examines the concepts of gender, gender based discrimination, gender stereotypes, patriarchy, gender based violence and gender equality\inequality. Also as law influences the formation, continuation, transformation and evolution of the gender based relations, this course also analyses how law carries out those functions by focusing on legal norms and practice.

HKUK308EU-Turkey Relations and Cyprus 
Catalog Description
In the course, Ankara Treaty and its additional protocols which constitute the core of EU-Turkey relations are explained in the first place. Then the association relations is compared to membership considering the association agreement and accession treaties. The course also focuses an the history of EU-Turkey relations. In this respect, Turkish application for membership on 14th of April 1987, the decision of Association Council on 6th of march 1995 regarding establishment of customs union between Turkey and EU ,the decisions taken in Helsinki European Council in 1999 regarding the criterias related with Cyprus Issue, the decision of European Council taken on 17th of December 2004. Negotiations Framework document adopted on 3rd of October 2005, decision of European Council in 2006 regarding the suspension of negotiations are explained in detail. Finally the rule of Cyprus Issue on the negatiations will be discussed.

The basic value which creates a connection between law and ethics is justice. Within this framework, legal rules and applications must be in conformity with requirements of justice. That is why people who are exercising this profession, in other words lawyers must be just people. Being just is connected with improving the feeling of justice. On the other hand feeling of justice is related with understanding and applying requirements of justice and acting according to these requirements. This course aims to teach ethical principles and values which are special to law profession and must be followed by lawyers. Professional ethics special to lawyers includes duties abaout making and enforcing codes.
